Sellers and lessors in France have been obliged for several years to provide their buyers and tenants with property surveys. As the years pass, the list of these surveys gets longer and longer. However, they are not all compulsory or are only compulsory under certain conditions, determined by date of construction, geographical area, etc.

All these surveys are paid for by the seller or lessor and must be carried out by a surveyor certified by an independent body. This guarantees that the surveyor has the necessary expertise to carry out the regulation survey(s). The surveyor must be totally independent and can, therefore, have no affiliations with an estate agent or notaire, for example.

It is essential to check that the surveyor is certified because in the event of a dispute, the transaction may be called into question. The production of technical property surveys exonerates the seller from the ‘garantie des vices cachés’ (guarantee against hidden defects), so obviously these must be carried out correctly.
